How Information Is Used

Personal information collected by ServiceLanka is used only for the purposes identified at the time of collection or as described below. Information will not be used for any purpose without prior consent unless required by law.

5.1Responding to Inquiries: Processing and responding to contact forms, emails, WhatsApp messages, and telephone inquiries.
5.2Facilitating Introductions: Connecting users with appropriate independent service providers, professionals, or businesses where requested.
5.3Scheduling: Coordinating and confirming consultation appointments and follow-up communications.
5.4Platform Improvement: Analysing usage data to improve website performance, functionality, and user experience.
5.5Security & Fraud Prevention: Monitoring for fraudulent, abusive, or unauthorised activity and protecting the platform and its users.
5.6Legal Compliance: Meeting obligations under applicable laws in Canada and Sri Lanka, including responding to lawful government or regulatory requests.
5.7Business Administration: Internal recordkeeping, dispute resolution, invoicing, and operational management.
5.8Direct Marketing (with consent): Sending updates, newsletters, or service announcements where express consent has been provided and not withdrawn. See Section 12.
5.9Third-Party Providers: Sharing limited information with independent service providers introduced to users, solely for the purpose of facilitating the requested introduction or communication.
No Sale of Personal Information: ServiceLanka does not sell, rent, trade, or otherwise transfer personal information to third parties for their own commercial purposes. Information shared with third parties is limited to what is necessary to fulfil the purposes described above.

Your Privacy Rights

Subject to applicable law, users located in Canada (PIPEDA) and Sri Lanka (PDPA No. 9 of 2022) have the following rights regarding their personal information:

7.1Right of Access: Request confirmation of whether ServiceLanka holds your personal information and obtain a copy of that information.
7.2Right of Correction / Rectification: Request correction of inaccurate, incomplete, or outdated personal information held by ServiceLanka.
7.3Right to Withdraw Consent: Withdraw consent for any processing based on consent, subject to reasonable notice and applicable legal obligations.
7.4Right to Erasure / Deletion: Request deletion of personal information where it is no longer necessary for the purposes for which it was collected and where no legal obligation requires retention. ServiceLanka may refuse deletion where required by law.
7.5Right to Object: Object to the processing of personal information for direct marketing or other non-essential purposes at any time.
7.6Right to Review Automated Decisions: Where automated decision-making is used, request human review of decisions that significantly affect you (PDPA — Sri Lanka specific).
7.7Right to Complain: Lodge a complaint with the Office of the Privacy Commissioner of Canada (OPC) at priv.gc.ca, or the Data Protection Authority of Sri Lanka (DPA) at dpa.gov.lk, if you believe your rights have been violated.
7.8Response Timeframe: ServiceLanka will respond to rights requests within 30 days for Canadian users (PIPEDA) and within a reasonable period for Sri Lankan users (PDPA). Where a request cannot be fulfilled, ServiceLanka will provide reasons in writing.

Data Retention

8.1Personal information is retained only as long as necessary to fulfil the purposes for which it was collected, unless a longer period is required or permitted by law.
8.2Inquiry and communication records may be retained for up to 7 years for legal, dispute resolution, and business continuity purposes.
8.3Technical and analytics data may be retained for up to 26 months (Google Analytics default retention period).
8.4Where information is no longer needed and no legal obligation requires retention, ServiceLanka will securely delete or anonymize the information.
8.5Users may request information about the retention period applicable to their specific data by contacting [email protected].

Data Security

9.1ServiceLanka implements reasonable technical and organisational safeguards to protect personal information against unauthorised access, disclosure, loss, alteration, or destruction.
9.2Safeguards include, where appropriate: encrypted communications (SSL/TLS), access controls, password protection, and secure hosting infrastructure.
9.3No electronic transmission or storage system can guarantee absolute security. Users acknowledge this inherent risk when transmitting personal information electronically.
9.4Third-party processors (hosting providers, analytics, communication tools) are expected to maintain appropriate security standards. ServiceLanka is not responsible for security failures on the part of independent third-party infrastructure providers beyond what is contractually required.
9.5ServiceLanka is not responsible for losses arising from malware, cyberattacks, unauthorised third-party access, internet outages, telecommunications failures, or software or hardware failures beyond its reasonable control.

Cross-Border Data Transfers

Because ServiceLanka operates in connection with activities in both Canada and Sri Lanka, personal information may be processed, stored, transmitted, reviewed, or accessed in either jurisdiction. Users are informed of the following:

10.1Information may be stored on servers located in Canada, Sri Lanka, the United States, or other jurisdictions used by hosting, analytics, communication, cloud, or security providers.
10.2When transferring personal information outside Canada, ServiceLanka uses comparable means of protection and acknowledges that foreign governments, courts, law enforcement, or regulatory agencies may be able to obtain access to personal information under the laws of those jurisdictions.
10.3For Sri Lankan users, cross-border transfers are conducted in accordance with the provisions of the PDPA No. 9 of 2022 and any applicable directions issued by the Data Protection Authority of Sri Lanka.
10.4By using this website, users consent to the cross-border transfer of their personal information as described in this section.

Direct Marketing & CASL Compliance

ServiceLanka complies with Canada’s Anti-Spam Legislation (CASL) and the direct marketing provisions of the Sri Lanka PDPA No. 9 of 2022.

12.1ServiceLanka will only send commercial electronic messages (newsletters, promotional emails, service updates) where the recipient has provided express or implied consent as defined by CASL.
12.2Every commercial message sent by ServiceLanka will include the sender’s identity, a valid mailing address, and a clear unsubscribe mechanism.
12.3Unsubscribe requests will be processed within 10 business days in accordance with CASL requirements.
12.4For Sri Lankan users, consent for direct marketing use of personal data is mandatory under PDPA, and clear opt-out mechanisms are provided at all times.
12.5Personal information is never shared or sold to third parties for their own marketing or advertising purposes.

ServiceLanka is committed to compliance with all ten fair information principles set out in Schedule 1 of PIPEDA, as enforced by the Office of the Privacy Commissioner of Canada.

Sri Lanka PDPA No. 9 of 2022 — Compliance

ServiceLanka acknowledges that the Personal Data Protection Act No. 9 of 2022, as amended by the Personal Data Protection (Amendment) Act No. 22 of 2025, applies to processing of personal data of Sri Lankan data subjects. ServiceLanka is committed to the following obligations under the PDPA:

14.1Lawful Processing: Personal data is processed lawfully, fairly, and transparently in accordance with PDPA Part I (Sections 5–12).
14.2Data Protection Management Programme: ServiceLanka implements a data protection management programme in compliance with Section 12 of the PDPA.
14.3Data Subject Rights: Sri Lankan users enjoy the full rights described in Section 7 of this policy, as guaranteed under PDPA Part II, including: right to withdraw consent, right to object, right of access and rectification, right to erasure, and right to request review of automated decision-making.
14.4Data Protection Authority: The Data Protection Authority of Sri Lanka (DPA), established under the PDPA in August 2023, oversees compliance. Complaints may be submitted to the DPA at dpa.gov.lk.
14.5Direct Marketing Consent: Consent from Sri Lankan data subjects is mandatory for direct marketing activities, with clear opt-out mechanisms provided at all times, in accordance with the PDPA’s direct marketing provisions.
14.6Cross-Border Transfers: Transfers of personal data outside Sri Lanka are conducted in accordance with the provisions of the PDPA and any applicable directions issued by the Data Protection Authority.

Independent Service Providers

15.1Any consultant, advisor, agency, business, contractor, professional, or service provider introduced through ServiceLanka operates entirely independently and under their own licences, registrations, qualifications, and legal obligations.
15.2Any service agreement, payment arrangement, engagement, representation agreement, or professional relationship is entered into solely between the user and the relevant independent service provider. ServiceLanka is not a party to such agreements.
15.3ServiceLanka assumes no responsibility for professional advice, immigration outcomes, visa decisions, employment decisions, government decisions, financial outcomes, business outcomes, contractual disputes, service quality, service delays, or provider conduct.
15.4No Verification Obligation: ServiceLanka is not obligated to verify the credentials, licensing status, financial condition, legal compliance, professional standing, insurance coverage, or suitability of any third-party provider introduced through the platform. Users are solely responsible for conducting independent due diligence.
15.5Business-to-Business Disclaimer: Where businesses are introduced to each other through ServiceLanka, ServiceLanka does not guarantee the solvency, legitimacy, licensing status, performance capability, compliance status, or commercial suitability of any party.

User Warranties & Representations

By using this website, each user represents and warrants to ServiceLanka that:

16.1All information submitted is accurate, truthful, current, complete, and provided with appropriate authority.
16.2The user is of legal age (18 years or older) or has obtained appropriate parental or guardian consent.
16.3Use of this website is for lawful purposes only and does not violate any applicable law or third-party rights.
16.4The user will not submit misleading, fraudulent, defamatory, unlawful, threatening, harassing, or infringing content.
16.5The user has independently evaluated the suitability of any service provider introduced through the platform and has not relied solely on ServiceLanka’s facilitation in making any decision.
16.6The user acknowledges that decisions involving immigration, employment, education, business formation, taxation, investments, licensing, and government applications involve inherent risks and accepts full personal responsibility for such decisions.

Acceptable Use Policy

Users must not engage in any of the following when accessing or using ServiceLanka:

Unlawful or fraudulent activity
Attempting unauthorised access to systems
Uploading malware, viruses, or harmful code
Submitting false or misleading information
Impersonating any person or entity
Sending unsolicited commercial messages (spam)
Scraping, crawling, or data harvesting
Interfering with website operations
Collecting others’ personal information
Violating any applicable law or regulation

ServiceLanka reserves the right to suspend or terminate access for any user who violates this Acceptable Use Policy, without notice and without liability.

Limitation of Liability

Maximum Liability Cap

To the maximum extent permitted by applicable law, if ServiceLanka is found legally liable despite the limitations in this section, total cumulative liability shall not exceed the greater of CAD $100 or the total amount paid directly to ServiceLanka by the user in the preceding twelve months.

20.1Exclusion of Damages: To the fullest extent permitted by law, ServiceLanka, Iraasadhani (Pvt) Ltd, Iraasadhani Inc., affiliates, officers, directors, shareholders, employees, consultants, agents, representatives, contractors, licensors, successors, and assigns shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, lost profit, lost opportunity, lost income, business interruption, reputational damage, or data-loss damages.
20.2Applicable Regardless of Theory: This limitation applies regardless of legal theory, including contract, negligence, tort, statutory liability, strict liability, or otherwise, and even if ServiceLanka has been advised of the possibility of such damages.
20.3No Warranty: All information and services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or accuracy.
20.4Accuracy of Information: ServiceLanka does not warrant that website content is complete, current, accurate, or reliable. Information may become outdated due to changes in law, regulations, government policy, or market conditions. Users are responsible for independently verifying all information.
20.5Website Availability: ServiceLanka may modify, suspend, restrict, discontinue, or update any portion of the website at any time without notice and without liability.
20.6Cybersecurity: ServiceLanka is not responsible for losses arising from malware, cyberattacks, unauthorised access, internet outages, telecommunications failures, software defects, hardware failures, or third-party technology disruptions beyond its reasonable control.

Liabilities and losses
Damages and judgments
Penalties and fines
Settlements and expenses
Legal fees and costs

Arising from: user misconduct; violations of applicable law; violations of these terms; misrepresentations in submitted information; content submitted through the website; reliance on user-provided information; or disputes involving third parties introduced through ServiceLanka.

Force Majeure

ServiceLanka shall not be liable for any delay, interruption, failure, or inability to perform its obligations resulting from circumstances beyond its reasonable control, including but not limited to:

Natural disasters or extreme weather
Government actions or regulations
Wars, civil unrest, or terrorism
Labour disputes or strikes
Internet or power failures
Cybersecurity incidents
Pandemics or public health events
Utility or infrastructure outages

Data Breach Notification

23.1Canada (PIPEDA): In the event of a breach of security safeguards that poses a real risk of significant harm to individuals, ServiceLanka will notify the Office of the Privacy Commissioner of Canada and the affected individuals as required under PIPEDA and the Security Breach Regulations.
23.2Sri Lanka (PDPA): In the event of a personal data breach, ServiceLanka will notify the Data Protection Authority of Sri Lanka and affected data subjects in accordance with the notification requirements of the PDPA No. 9 of 2022.
23.3Breach notifications will include, where required: a description of the breach, the type of information involved, steps taken to address the breach, and recommendations for affected individuals.
23.4ServiceLanka maintains records of all security breaches, whether or not notification is required, in accordance with its legal obligations.

Children’s Privacy

This website is intended for adults (18 years and older) and for business users. ServiceLanka does not knowingly collect, use, or disclose personal information from individuals under the age of 18 without verifiable parental or guardian consent. If ServiceLanka becomes aware that personal information from a minor has been collected without proper consent, it will take immediate steps to delete such information. Governing Law & Jurisdiction

26.1These terms are governed by and construed in accordance with the laws of Canada, including applicable federal laws and the laws of the province in which Iraasadhani Inc. is registered, without regard to conflict of law principles.
26.2For activities and users based in Sri Lanka, the laws of Sri Lanka apply to the extent required by applicable Sri Lankan legislation, including the PDPA No. 9 of 2022.
26.3Users irrevocably submit to the non-exclusive jurisdiction of the courts of the applicable governing jurisdiction for resolution of any dispute not resolved through the process described in Section 27.
26.4Privacy complaints may be directed to the Office of the Privacy Commissioner of Canada (priv.gc.ca) or the Data Protection Authority of Sri Lanka (dpa.gov.lk), as applicable.
27

General Provisions

27.1Entire Agreement: These terms, together with any separate written agreements, constitute the entire agreement between users and ServiceLanka regarding use of this website and supersede all prior communications, understandings, representations, and negotiations.
27.2Severability: If any provision of these terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be severed and the remaining provisions shall continue in full force and effect.
27.3No Waiver: Failure or delay by ServiceLanka to enforce any provision of these terms shall not constitute a waiver of that provision or any other right or provision.
27.4Assignment: ServiceLanka may assign or transfer its rights and obligations under these terms without user consent. Users may not assign their rights or obligations without prior written consent from ServiceLanka.
27.5Dispute Resolution: In the event of any dispute, the parties agree to first attempt resolution through good-faith negotiation. If unresolved after 30 days, disputes may be escalated to the applicable regulatory authority or courts as set out in Section 26.
27.6Language: These terms are written in English. In the event of any conflict between an English version and any translated version, the English version shall prevail.
